These Terms of Service ("Terms") govern your use of Beamd (beamd.live), operated by Vaulted Media Group LLC, a Texas limited liability company, doing business as Beamd ("we", "us", "our"). By creating an account or using the service you agree to these Terms. If you do not agree, do not use Beamd.
Beamd lets you upload pre-recorded video content and stream it on a loop to third-party platforms (YouTube, Twitch, and others). We provide the infrastructure; you are responsible for the content you stream and for complying with the terms of any platform you stream to.
You must provide a valid email address and keep your account credentials secure. You are responsible for all activity that occurs under your account. Notify us immediately at hello@beamd.live if you believe your account has been compromised.
You must be at least 18 years old to use Beamd, or older if the age of majority where you live is higher than 18.
New accounts receive a 72-hour free trial with no credit card required. At the end of the trial your streams will stop and you will need to subscribe to continue using the service. We reserve the right to modify or end the trial offer at any time.
Paid plans are billed monthly or annually in advance via Stripe. Prices are shown in USD. By subscribing you authorise us to charge your payment method on a recurring basis until you cancel.
Refunds: Monthly plans may be cancelled at any time; your access continues until the end of the current billing period and no partial refunds are issued. Annual plans are non-refundable after 7 days from the date of purchase. If you experience a service failure caused by us within those 7 days, contact us and we will make it right.
We may change prices with 30 days' notice. If you disagree with a price change you may cancel before it takes effect.
You agree not to use Beamd to stream or store content that:
Violations may result in immediate account suspension without refund. Serious or repeated violations will result in permanent termination.
You retain ownership of all content you upload. By uploading content you grant us a limited, non-exclusive licence to store, process, and transmit it solely for the purpose of providing the service to you. We do not claim any ownership over your content and do not use it for any other purpose.
You are solely responsible for ensuring you have the rights to stream any content you upload, including music, video clips, and graphics.
You represent and warrant that you own, or have obtained, every right, licence, consent and permission needed to upload your content to Beamd and to transmit it continuously to each platform you select, including any right in the underlying video, in music and audio, in graphics and fonts, and any right of a person appearing in it. This warranty is one of the things we rely on in agreeing to carry your content, and it is the basis of the indemnity below.
If you are not certain you hold those rights for something, do not upload it. Streaming a film, a match, a broadcast, or a music track you did not create or licence is the most common way an account is terminated, and it exposes you rather than us.
We aim for high availability but do not guarantee uninterrupted service. Streams may be interrupted due to network issues, platform outages (YouTube, Twitch, etc.), server maintenance, or events outside our control. We are not liable for losses caused by stream interruptions.
We may perform scheduled maintenance with reasonable notice and will try to minimise disruption.
The Beamd platform, name, logo, and all associated software are our intellectual property. You may not copy, modify, distribute, or reverse-engineer any part of the service.
To the maximum extent permitted by law, Beamd and its operators shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the service, including lost revenue, lost data, or missed streaming opportunities. Our total liability to you for any claim shall not exceed the amount you paid us in the 3 months prior to the claim.
The service is provided "as is" and "as available", without warranties of any kind, whether express or implied. To the fullest extent permitted by law we disclaim all implied warranties, including any warranty of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the service will be uninterrupted, error free, or that any stream will reach any particular platform or audience.
The support assistant on our website and inside the app gives guidance only. Its answers are produced automatically, may be wrong or out of date, and do not form part of the service or of any commitment we make to you. Check anything that matters against the app itself, or email us.
You agree to defend, indemnify, and hold harmless Beamd, Vaulted Media Group LLC, and its officers and employees from any claim, demand, loss, or expense (including reasonable legal fees) arising out of the content you upload or stream, your breach of these Terms, or your violation of any law or of any third party's rights. This includes claims brought by a copyright owner in respect of material you streamed through the service.
We are not liable for any failure or delay in providing the service caused by events beyond our reasonable control, including but not limited to acts of God, fire, flood, war, civil unrest, strikes, government action, failures of the public internet, failures or changes at our hosting or storage providers, and outages, policy changes, or account actions at any platform you stream to.
You are responsible for holding the rights to everything you stream. If a copyright owner tells us that material streamed through Beamd infringes their rights, we will act on that notice, including removing or disabling access to the material. Accounts that repeatedly infringe will be terminated. Our full notice and takedown process, and the address for sending a notice, is set out in our Copyright Policy, which forms part of these Terms.
You may cancel your account at any time from your account settings. We may suspend or terminate your account if you breach these Terms, if required by law, or if we discontinue the service. Upon termination, your content will be deleted within 30 days.
We may update these Terms from time to time. We will notify you by email at least 14 days before material changes take effect. Continued use of the service after that date constitutes acceptance of the new Terms.
These Terms are governed by the laws of the State of Texas, without regard to its conflict of law provisions.
Nothing in these Terms removes rights you have under the mandatory consumer protection laws of the country or state where you live. Where those laws give you rights that cannot be contracted out of, they apply alongside these Terms.
Disputes will be heard in the state or federal courts located in Texas. If you are a consumer living outside the United States, you may also bring proceedings in the courts of the country where you live, and we will bring any claim against you in the courts of the country where you live.
